NEW YORK — Alex Rodriguez sued Major League Baseball and its players union Monday, seeking to overturn a season-long suspension imposed by an arbitrator who ruled there was “clear and convincing evidence” the New York Yankees star used three banned substances and twice tried to obstruct the sports drug investigation. As part of the complaint filed in federal court in Manhattan, Rodriguezs lawyers made public Saturdays 34-page decision by arbitrator Fredric Horowitz, who shortened a penalty originally set at 211 games last August by baseball Commissioner Bud Selig for violations of the sports drug agreement and labour contract. Horowitz, a 65-year-old making his second decision as baseballs independent arbitrator, trimmed the discipline to 162 games, plus all post-season games in 2014. “While this length of suspension may be unprecedented for a MLB player, so is the misconduct he committed,” Horowitz wrote. Horowitz concluded Rodriguez used testosterone, human growth hormone and Insulin-like growth factor-1 in 2010, 2011 and 2012 in violation of baseballs Joint Drug Agreement. He relied on evidence provided by the founder of the now-closed Biogenesis of America anti-aging clinic in Florida. “Direct evidence of those violations was supplied by the testimony of Anthony Bosch and corroborated with excerpts from Boschs personal composition notebooks, BBMs (Blackberry messages) exchanged between Bosch and Rodriguez, and reasonable inferences drawn from the entire record of evidence,” Horowitz wrote. “The testimony was direct, credible and squarely corroborated by excerpts from several of the hundreds of pages of his composition notebooks.” While the original notebooks were stolen, Horowitz allowed copies into evidence. Rodriguezs suit accused the Major League Baseball Players Association of “bad faith,” said its representation during the hearing was “perfunctory at best” and accused it of failing to attack a civil suit filed by MLB in Florida state court as part of its Biogenesis investigation. His lawyers criticized Michael Weiner, the union head who died from a brain tumour in November, for saying last summer he recommended Rodriguez settle for a lesser penalty if MLB were to offer an acceptable length. “His claim is completely without merit, and we will aggressively defend ourselves and our members from these baseless charges,” new union head Tony Clark said in a statement. “The players association has vigorously defended Mr. Rodriguezs rights throughout the Biogenesis investigation, and indeed throughout his career. Mr. Rodriguezs allegation that the association has failed to fairly represent him is outrageous, and his gratuitous attacks on our former executive director, Michael Weiner, are inexcusable.” The suit also claimed MLB engaged in “ethically challenged behaviour” and was the source of media leaks in violation of baseballs confidentiality rules. Rodriguezs lawyers said Horowitz acted “with evident partiality” and “refused to entertain evidence that was pertinent and material.” They faulted Horowitz for denying Rodriguezs request to have a different arbitrator hear the case, for not ordering Selig to testify and for allowing Bosch to claim Fifth Amendment rights against self-incrimination in refusing to answer questions during cross-examination. They also said Horowitz let the league introduce “unauthenticated documents and hearsay evidence … obtained by theft, coercion or payment,” wouldnt allow them to examine Blackberry devices introduced by MLB and was fearful he would be fired if he didnt side with management. Rodriguez asked the court to throw out Horowitzs decision and find the league violated its agreements with the union and that the union breached its duty to represent him. The case was assigned to U.S. District Judge Edgardo Ramos. Supreme Court decisions have set narrow grounds for judges to vacate arbitration decisions, instances such as corruption or not following the rules agreed to by the parties. The three-time AL MVP admitted five years ago he used performance-enhancing substances while with Texas from 2001-03, but the third baseman has denied using them since. MLBs Biogenesis investigation was sparked after the publication of documents last January by Miami New Times. Bosch agreed in June to co-operate with MLB and testified during the hearing, which ran from September until November. Rodriguezs lawyers attacked his credibility because of that deal, which included reimbursement by MLB for costs of lawyers, up to $2,400 daily for security, insulation from civil suits and a promise to tell law enforcement he was co-operative. “The benefits accorded to Bosch under that arrangement did not involve inducements that the panel considers to be improper,” wrote Horowitz, who chaired a three-man panel that included MLB Chief Operating Officer Rob Manfred and union General Counsel David Prouty. Horowitz cited the credibility of Boschs “unrebutted testimony — testimony which was corroborated by substantial documentary evidence,” and he described how Bosch and Rodriguez communicated in code, referring to banned substances as “food.” “Once when Bosch sent a message telling Rodriguez that he was going to pick up Rodriguezs meds, Rodriguez replied Not meds dude. Food,” the arbitrator wrote. Rodriguez did not testify in the grievance, walking out after Horowitz refused to order Selig to testify. At a brief hearing Monday, MLB said it would not discipline Rodriguez for including the decision in his lawsuit. U.S. District Judge William H. Pauley III brushed aside concerns from the union about confidentiality concerns. “Given the intense public interest in this matter and Commissioner Seligs disclosures last night on 60 Minutes, its difficult to imagine that any portion of this proceeding should be under seal,” Pauley said. The arbitrator noted Bosch and Rodriguez exchanged 556 text messages and had 53 telephone calls in 2012. He said all records of text messages were produced by Bosch, while lawyers for Rodriguez said the Blackberry he used to communicate with Bosch was deactivated last March and Rodriguez no longer had it. The arbitrator said Rodriguez instructed Bosch in one message to “erase all these messages.” Horowitz recounted how Rodriguez was introduced to Bosch after a Yankees game in Tampa, Fla., in July 2010 by A-Rods cousin, Yuri Sucart, who knew Bosch through Jorge “Oggi” Velazquez. Horowitz wrote MLB was justified in citing violations of the collective bargaining agreement because Rodriguez “played an active role in inducing Bosch to issue his own public denial on Jan. 29” and “attempted to induce Bosch to sign a sworn statement on May 31” saying he never supplied the player. In determining the length of the penalty, Horowitz cited a 2008 decision in a grievance involving Neifi Perez in which arbitrator Shyam Das ruled “separate uses are subject to separate disciplines.” He said under the discipline system for positive tests, Rodriguez would be subject to at least 150 games for three violations of 50 games. Still, Horowitz thought Seligs initial penalty was too severe. “A suspension of one season satisfies the structures of just cause as commensurate with the severity of his violations,” he wrote. Rodriguezs lawyers claimed at worst the case should involve one first violation with a penalty of 50 games, and they said including the 2014 post-season was beyond the scope of Seligs original discipline. Horowitz rejected Rodriguezs argument that the lack of a positive test was proof of innocence. “It is recognized Rodriguez passed 11 drug tests administered by MLB from 2010 through 2012. The assertion that Rodriguez would have failed those tests had he consumed those PES as alleged is not persuasive. As advanced as MLBs program has become, no drug-testing program will catch every player,” Horowitz wrote. The Jaguars signed former Seattle Seahawks defensive end Chris Clemons, former Pittsburgh Steelers defensive lineman Ziggy Hood and re-signed veteran Jason Babin, who led the team with 7 1/2 sacks in 2013. Those moves came five days after Jacksonville signed former Seattle defensive end Red Bryant. Together, they could drastically improve a defence that tied for last in the league with 31 sacks last season. “Hopefully get with these guys and take this thing to a whole new level,” Hood said. CAPE TOWN, South Africa — Victor Matfield will attempt to win the Rugby World Cup again with South Africa next year at the age of 38 after his playing return was announced on Friday — more than two years after he retired. MILWAUKEE — The New York Yankees injury-plagued rotation has taken another big hit. Struggling left-hander CC Sabathia was placed on the 15-day disabled list before Sundays 6-5 loss to the Milwaukee Brewers with inflammation in his right knee. Manager Joe Girardi said he hoped Sabathia would just need two weeks. Sabathia had right knee surgery at the end of the 2006 season while with the Cleveland Indians. This is the only time he has experienced inflammation since the operation, Sabathia said. LAS VEGAS — It was the first question for Canadian Rory (Ares) MacDonald at the UFC 167 public workouts. If the third-ranked MacDonald and welterweight champion Georges St-Pierre win on the weekend, will the two training partners have to fight each other. “No,” said MacDonald, before pausing. “Next question?” Rashad Evans and Chael Sonnen, however, will put friendship aside Saturday when they face off in the co-main event at the MGM Grand Garden Arena. The two are no strangers to working in close quarters. When they are not fighting, they sit next to each other as TV analysts on UFC shows on Fox. After their fight, they will be reunited two weeks later to do coverage on a UFC weigh-in show. The 34-year-old Evans, a former light-heavyweight champion, is currently ranked the No. 4 contender in the 205-pound division ruled by Jon (Bones) Jones. The 36-year-old Sonnen, who has competed for the title at both 185 and 205 pounds, is ranked No. 6. Sonnen (29-13-1) is coming off an August win over former light-heavyweight champion Mauricio (Shogun) Rua. He had lost two straight title shots before that — to Jones and then-middleweight champion Anderson Silva. Evans (23-3-1) beat Dan Henderson last time out in August. That followed losses to Antonio Rogerio Nogueira and Jones. Sonnen-Evans may be a case of be careful of what you wish for. When Sonnen heard St-Pierre was headlining UFC 167, a marquee card that celebrates the UFCs 20-year anniversary, he asked to fight Wanderlei (The Axe Murderer) Silva in the co-main event. “Then I asked to be put in it with anybody but Rashad,” he said. “But I ended up with Rashad, so I got half my wish.” Sonnen and Evans were doing commentary work at a UFC show in Indianapolis in August when UFC president Dana White texted Sonnen to say he needed to talk to him about his next fight. “And I said as long as its at 205 and its not Rashad, Im in. And he wrote back It is Rashad. So I held the phone up to Rashad — we were on a commercial break — and just let him read it. And I didnt say anything. He read the whole thing.” A few minutes later on the show, Sonnen had to turn to Evans to set him up for the next segment. “I could feel him sizing me up the whole rest of the show. And I felt myself doing the same thing to him.” “Thats the way it goes,” he added. “Its not the fight either of us wanted but were both leaders within the locker-room with the guys at the back. We cant set an example that you pick and choose your fights. You dont. Youve got to compete with everybody.” Evans recalled the moment, noting the two had believed they wouldnt be pitted against each other. “Just because we have such good working chemistry (on TV) and I thought maybe they wouldnt do that just because it would bring a little bit of awkwardness. But we were both wrong.” Evans says he usually sees his opponent and starts thinking “Oh, man Im going to punch him in his face.” Not this time, although Evans believes that when the bell rings he will be able to “hit the switch and just make it a fight.” White, who rarely sees a matchup he cant make, says Evans-Sonnen was simply the right fight at this time. The UFC boss, for the record, believes MacDonald will leave GSPs gym after this fight and start training on his own, setting the stage for an all-Canadian welterweight showdown. Both Sonnen and Evans have elite amateur wrestling credentials. Sonnen was a U.S. Olympic team alternate and NCAA all-American while Evans was a national junior college champion and NCAA all-American. Evans has landed 49 takedowns, the most in the UFC light-heavyweight division. Sonnen has 35, the most as a middleweight. Sonnen believes their wrestling skills might cancel each other out. “I anticipate that from a fans perspective, it will be a different fight than anyone has seen either of us have before,” said Sonnen. “Well both have to go to some other hold … This isnt a new spot but its a tough one. And Im going to have it figure it out on the fly,” he added. Evans isnt buying it. “Lets be honest here. Chael Sonnen has one way of fighting and thats coming straight at you. It doesnt matter who you are, it doesnt matter what your game plan is. He has one game plan and thats to impose his will.” Sonnen is like a blanket and looks to envelop his opponent from the get-go. And once he gets you down to the ground, he looks to punish and finish. Evans, meanwhile, combines speed and power, above a good wrestling base. Sonnen has got some intel from Henderson, his good friend and sometime training partner, on Evans. “He commented on how quick Rashad is and how difficult he is to hit, with his movement.” Evans is also back on his game, after his UFC 145 title loss to Jones that saw a bitter break with his former camp at Jacksons MMA where Jones also trained. “Those guys were family for me for a long time before he (Jones) came into the picture. So it was kind of a sense of me losing a piece of my family and that hurt and that stung more than anything, than the fight itself.” Evans formed his own camp, known as the Blackzilians, in Boca Raton, Fla., and says he has benefited from moving forward and ridding himself of past resentment. “No longer did I have those feelings of betrayal that I had before. I had a different understanding of the whole situation, which is the fact that sometimes in life people just have to go in different directions. And sometimes its good, and sometimes its hard to do. But at the same time, nevertheless we all have to go in (our) own direction at some point.” Sonnen has also changed. At times in his career, especially when hyping up his two fights with then middleweight champion Anderson Silva, Sonnen has veered between carnival barker and pro wrestler in his on-camera persona as a fighter. But he has been a gentleman in recent times, both candid and cerebral. Asked about his first-round submission win over Rua, he was gracious in victory. “I dont think Shogun was ready to go that night. I think he was too much of a sportsman to make any excuses, unlike most guys. I think he let me have my moment. I dont think that was the real Shogun that I faced.” And Sonnen played down any idea of good-natured trash-talking if he wins Saturday. “Im a pretty good winner, a pretty good loser,” he said. “I understand its competition. Ticketholders will need to obtain “spectator passes,” providing passport and other information to authorities. Email, phone and internet usage will reportedly be monitored by Russian security agencies. Putin is expected to attend many Olympic events, causing further security lockdowns. A heavy presence of Russian security forces could turn the games into an armed camp and undermine any prospect of a welcoming, festival atmosphere. GAY RIGHTS: The Russian law banning gay “propaganda” has caused a furious backlash in the West and tarnished the countrys international reputation heading into the Olympics. While Russia has promised there will be no discrimination at the games, critics continue to bash the law. The IOC has been assailed for not pushing Russia to repeal the legislation. Some athletes are planning to make their views known in Sochi, either by speaking out or carrying or wearing symbols promoting gay rights. Thats something which could land athletes in trouble with the IOC, which prohibits any political gestures at the games. HUMAN RIGHTS: Russias human rights record remains under scrutiny. With the games approaching, Putin has launched a charm offensive of sorts - pardoning former oil tycoon Mikhail Khodorkovsky and granting amnesty for Pussy Riot punk band members and Greenpeace activists. He has even rescinded an order banning any demonstrations in or around the games. Critics call the moves window dressing. Will protest applications be granted? Will anyone dare come out to demonstrate? Meanwhile, Human Rights Watch has accused Russian authorities of mistreating migrant workers and harassing activists and journalists. PUTINS POLITICS: Putins prickly relations with the West have soured any “feel-good” factor about the Olympics. Tensions with the U.S. and President Barack Obama grew after Putin granted temporary asylum to NSA leaker Edward Snowden. Putins policies on Syria and Iran, and Russias backsliding on democratic reforms have antagonized Western leaders. For the first time since 2000, the U.S. delegation to the Olympics will not include a president, vice-president or first lady. Obama is sending several openly gay athletes, including tennis great Billie Jean King and figure skater Brian Boitano. French President Francois Hollande and German President Joachim Gauck are not going to Sochi, either. WEATHER WORRIES: Sochi is a subtropical resort on the Black Sea. Temperatures on the coast, where the indoor ice events will be held, will be mild. Thats fine, but there is uncertainty over conditions in the mountains for the snow events. While there iss already a good layer of snow in place, a spell of warm or wet weather could cause problems.dddddddddddd. As a precaution, organizers have stored up 450,000 cubic meters of snow. Also worth noting: flooding and avalanches are common in the region. RECORD COST: $51 billion. Thats the overall price tag for the games, by far the most expensive in history, summer or winter, and more than three times the budget of the 2012 London Games. The cost includes the long-term investment in roads, tunnels, railways and ski facilities. Everything has been built from scratch as Russia seeks to turn Sochi into a year-round tourist destination. BELLEFONTE, Pa. — In what sounded at times like a locker-room pep talk, Jerry Sandusky rambled in his red prison suit about being the underdog in the fourth quarter, about forgiveness, about dogs and about the movie “Seabiscuit.” With his accusers seated behind him in the courtroom, he denied committing “disgusting acts” against children and instead painted himself as the victim. And then, after he had said his piece, a judge sentenced him to 30 to 60 years in prison Tuesday, all but ensuring the 68-year-old Sandusky will spend the rest of his life behind bars for the child sexual abuse scandal that brought disgrace to Penn State and triggered the downfall of his former boss, football coach Joe Paterno. He leaves behind a trail of human and legal wreckage that could take years for the university to clear away. “The tragedy of this crime is that its a story of betrayal. The most obvious aspect is your betrayal of 10 children,” Judge John Cleland said after a hearing in which three of the men Sandusky was convicted of molesting as boys confronted him face to face and told of the lasting pain he had inflicted. The judge said he expects Sandusky to die in prison. In a disjointed, 15-minute address before he learned his sentence, Sandusky said: “In my heart I did not do these alleged disgusting acts.” Sprinkling his remarks with sports references, the former assistant coach spoke of being locked up in a jail cell, subjected to outbursts from fellow inmates, reading inspirational books and trying to find a purpose in his fate. His voice cracked as he talked about missing his loved ones, including his wife, Dottie, who was in the gallery. “Hopefully we can get better as a result of our hardship and suffering, that somehow, some way, something good will come out of this,” Sandusky said. He also spoke of instances in which he helped children and did good works in the community, adding: “Ive forgiven, Ive been forgiven. Ive comforted others, Ive been comforted. Ive been kissed by dogs, Ive been bit by dogs. Ive conformed, Ive also been different. Ive been me. Ive been loved, Ive been hated.” Sandusky was convicted in June of 45 counts, found guilty of raping or fondling boys he had met through the acclaimed youth charity he founded, The Second Mile. He plans to appeal, arguing among other things that his defence was not given enough time to prepare for trial after his arrest last November. Among the victims who spoke in court Tuesday was a young man who said he was 11 when Sandusky groped him in a shower in 1998. He said Sandusky is in denial and should “stop coming up with excuses.” “Ive been left with deep painful wounds that you caused and had been buried in the garden of my heart for many years,” he said. Another man said he was 13 in 2001 when Sandusky lured him into a Penn State sauna and then a shower and forced him to touch the ex-coach. “I am troubled with flashbacks of his naked body, something that will never be erased from my memory,” he said. After the sentencing, prosecutor Joe McGettigan praised the victims courage and dismissed Sanduskys comments as “a masterpiece of banal self-delusion, completely untethered from reality and without any acceptance of responsibility.” “It was entirely self-focused as if he, again, were the victim,” McGettigan said. Lawyers for the victims said they were satisfied with the sentence, but with four lawsuits brought against Penn State and several more expected, and Penn State labouring under severe NCAA penalties, cleaning up in the wake of what may be the biggest scandal in college sports history may take years. Ben Andreozzi, a lawyer for one the victims, said the university needs to do more: “Its important they understand before we get into serious discussions about money, that there are other, noneconomic issues. Christine Sinclair has witnessed many highs and lows over the last 10 years with the Canadian womens soccer team, but through it all her reliably excellent play has been the teams backbone. That consistency was rewarded Friday when Sinclair was named Canadian womens soccer player of the year for the 10th straight time, and 11th overall. Her latest accolade came a day after the 30-year-old forward from Burnaby, B.C., marked her 200th appearance for Canada and scored her 147th career international goal in a 2-0 win over Scotland. “Internationally Ive been a part of this team for a while and been through many ups and downs, and three coaches, but its clear to see the program is progressing,” Sinclair said Friday on a conference call from Brazil, where Canada is participating in the Torneio Internacional de Futebol Feminino. “I think both technically and tactically, the support from the federation, everything seems to be going in the right direction building towards 2015,” she added. The national womens program is in a good place heading into 2015, when Canada will host the FIFA Womens World Cup. Canada won its first ever Pan Am Games gold medal in 2011, then made its mark on the nations sports landscape with a bronze medal at the 2012 London Olympics. “Very few people get an opportunity to actually play in a World Cup at home, but I think we have a shot at doing very well,” Sinclair said. “Everything were doing is building toward that and trying to prove to everyone that what happened in London isnt a one-off thing and that its sustainable. That Canada is a forced to be reckoned within the international scene.” Sinclair called her international experience this year “interesting.” She missed Canadas first four international games due to a suspension stemming from an altercation with an official after Canadas semifinal loss to the U.S. at the London Games. She also said that Canada is currently in a building phase and developing younger players for the main squad, which has meant results have been muted following an explosive 2012. But on the club level, Sinclair had a season to remember. She led the Portland Thorns to the NWSL championship with eight goals in 20 matches. It marked her third straight club title, having won in 2010 with FC Gold Pride and 2011 with the Western New York Flash. “I have many ties to the Portland area having gone to university there,” she said. “Its a soccer-crazy city, and being able to reward those fans and that organization with a championship, it just meant so much to me to be able to give that to the city.” Sinclair added that as big as international womens soccer is getting, a healthy domestic league will do a lot to help to grow the game. “For me its all about doing everything I can to help the NWSL survive,” she said. "Its my goal to have this league around for years to come, so that nine- and 10-year-olds now have a place to play when theyre done with university and a place to dream of playing. “Very few people make national teams, but it doesnt mean that once youre done your university or youth club career that your soccer career should be over.” Sinclair made the 10-player shortlist for the 2013 FIFA Womens World Player of the Year award and was honoured on Canadas Walk of Fame. Sinclair first won the Canadian award in 2000 and has made it her own since 2004. Six men have won the male half of the award since then. A lot has happened since her first award, from the highs of playing in the 2002 under-19 World Cup final in front of a big crowd at Edmontons Commonwealth Stadium, to the lows of finishing in last place at the 2011 World Cup in Germany. “I remember back to 2002 with the under-19 world championship and there being almost 50,000 fans at the final and thinking All right, womens soccer has arrived in this country,” she said. “And then we went through a little bit of a lull. As a national team we didnt perform as well as we would have hoped to, and you didnt see the huge increases in attendance. But obviously what happened in London has blown everyones expectations out of the water.” Sinclair said the benefits of winning an Olympic medal go right down to soccers youth level. “Just little kids who recognize all of us, because when I was that age I had no idea there was even a national team,” she said. “Now these kids have female athletes as role models and they dream of being the next Erin McLeod (Canadas goalkeeper), that never happened 15 years ago.” Midfielder Diana Matheson was runner-up for the Canadian soccer award, followed by McLeod and midfielder Desiree Scott. PHILADELPHIA — The San Jose Sharks made a simple change to rally for a comeback victory over the Philadelphia Flyers. They started shooting the puck. Joe Pavelski had a hat trick to move into a tie for second in the NHL in goals and the Sharks beat Philadelphia 7-3 Thursday night in the first game for both teams following the Olympic break. Raffi Torres and Logan Couture each scored twice in their return to San Joses lineup following injuries. The Sharks trailed 2-1 after getting outshot 10-4 in the first period. San Jose made a pointed effort to shoot the puck in the second period and it paid off in a big way, resulting in five second-period goals on 16 shots. “We started to finally shoot the puck,” Couture said. “The first period we werent shooting. We were playing in their end, but we werent shooting. Thats more the way we play, the way we need to play. A lot of our goals were off rebounds, and thats the way you score in this league.” Pavelski, one of the Sharks four Olympians, scored all three of his goals in the dominating second period. Torres, who was making his 2013-14 debut after injuring his knee in the preseason, capped the second-period spree with his second goal of the game with 2.2 seconds left. HOYLAKE, England — Even after his worst 72-hole finish in a major, Tiger Woods says he would pick himself for the Ryder Cup team. His first major of the year, and second tournament since March 31 back surgery, wasnt much of an audition for U.S. captain Tom Watson. LOS ANGELES — Los Angeles Lakers coach Mike DAntoni resigned Wednesday after less than two seasons on the job. Team spokesman John Black confirmed DAntonis resignation, ending the brief tenure of the Lakers fourth head coach in less than three years. The Oscar Pistorius trial has resumed following a month long break. During that time, Pistorius underwent a psychiatric evaluation at the direction of the court to determine if he suffered from general anxiety disorder (GAD) at the time he killed Reeva Steenkamp. The Charges The issue being determined at trial is whether Pistorius killed Steenkamp intentionally, or as Pistorius alleges, he killed her by accident believing her to be an intruder. Form a legal standpoint, this distinction is really important since it ties into the charges faced by Pistorius. There are three possible scenarios with respect to the charges: Premeditated murder, murder and culpable homicide. Premeditated murder requires an intent to murder plus planning the murder. Premeditation is reserved for more robust planning and generally doesnt capture an intent that materialized right before a crime was committed. There was no significant planning to the crime, so premeditated murder will likely fail. Even if the prosecution cant make out premeditated murder, it can still get Pistorius on the lesser charge of murder. In order establish murder, they only need to show that he intended to kill Steenkamp (no planning element needed).Should the prosecution fail on murder, there is another lesser charge that could come into play: culpable homicide. This charge means that Pistorius negligently killed Steenkamp (or that he killed her by accident). Premeditated murder would get Pistorius a compulsory life sentence, while murder would result in a compulsory sentence of 15 years. For culpable homicide, the sentencing is discretionary (varies from fines to prison time), although its not unusual to see prison time in South Africa of 5-10 years for this type of crime. Facing very serious charges, the defence team wanted to establish that Pistorius should not go to jail because he was mentally ill when he fired those four gunshots the night of Valentines Day. And thats where GAD comes into play. General Anxiety Disorder And Diminished Capacity A defendant that suffers from a mental disorder can be found not criminally responsible on the basis that he or she could not appreciate the difference between right and wrong at the time the crime was committed. If such a finding is made, one possible outcome is the trial ends right then and there, and the defendant is committed to an institution indefinitely. In essence, it would look very much like an acquittal with ongoing psychiatric care. So if it was concluded that Pistorius had a mental disorder that made him incapable of appreciating the wrongfulness of his act, the trial could have come to a very abrupt end and Pistorius could have avoided jail time. Psychiatric Finding The psychiatric report concluded that Pistorius was not mentally ill at the time he killed Steenkamp. As per the report, “at the time of the alleged offenses, the accused did not suffer from a mental disorder or mental defect that affected his ability to distinguish between the rightful or wrongful nature of his deeds”. So that means the trial continues and Pistorius does not avoid prison in favour of an institution. Mental Illness No. 2: Post-Traumatic Stress Disorder Things didnt end with GAD. On July 2, the defence team declared that Pistorius was suffering from post-traumatic stress disorder (PTSD) and as result was suicidal. “He is…mourning the loss of Ms Steenkamp,” said Barry Roux, Pistorius lawyer. “Should he not receive proper clinical care, his condition is likely to worsen and increase the risks for suicide.” Is this a meaningful finding with respect to exonerating Pistorius? No. This mental disorder speaks to Pistorius state of mind AFTER the murder and not before or during the act. The key is in the name of the affliction: POST-traumatic stress disorder and not PRE-traumatic stress disorder. So that means that even if it can be shown that Pistorius suffers from PTSD, his mental illness did not render him unable to appreciate the difference between right and wrong at the time of the killing since he would have only developed the illness after the crime. Injured Tampa Bay Lightning star Steven Stamkos said hes feeling better after taking a day off from practice on Monday because his leg didnt feel right. Tucker was sentenced to three days in jail and 11 days of home detention Monday after pleading guilty to “super extreme” driving under the influence. “I am truly sorry and I take full responsibility for my actions.
